Can I change lawyers in the middle of my divorce?  I don’t feel like my attorney is fighting for me.

Yes, you can.  If you feel that your divorce lawyer is not serving your best interests, in fact you should change attorneys.  I have taken over numerous divorces, in particular when financial and custody issues are the problem.  I have a proactive approach and will fight for my client’s wishes in those issues most important to them.

It is important to me that I get primary custody of my children, and I believe it is best for them.  On what criteria does the court base the decision on primary custody?

Florida law is written to protect children.  As each case is completely unique, and if the two parents are both asking for primary custody of the children, each home environment will be looked into and the one that appears to serve the best interests of the children will most likely be the home that is given primary custody.  There is also the option of shared custody, which may be the right solution.  I, Wesley Owens, Family Law Attorney, believe that it is crucial to reduce the conflicts and increase the benefits in any divorce case.

Will I get to continue to live in the family home after the divorce?

Ordinarily, after a divorce, the parent who gets primary custody of the children will be the one that is allowed to continue to live in the family home.  There are exceptions to this, and each case is decided based on the information provided to the court by the attorneys for each party.  It is extremely important who you choose to represent you in any divorce case.

Can’t I do my own uncontested divorce, without a lawyer?

Any person can represent themselves in court, whether divorce court or criminal court.   The question is: is it worth it?  When you try to complete a legal filing without training, you could make errors that will cost you in the future.  I have had many couples who attempted to do their own uncontested divorce and eventually realized that they needed help.  It is much easier to have legal assistance from our firm and ensure that the divorce is done correctly.
